ENTRY/DATES. Enter between March 7, 2021 11:00am PST and March 11, 2021 11:59pm PST. Limit one entry per person. Enter on Instagram by visiting https://www.instagram.com/draisbeachclub/ and look for our sweepstakes post and: i) comment on the post by answering the question;  ii) follow @[draisbeachclub]; and iii) tag three friends in the comments.

ELIGIBILITY: The Sweepstakes is open to legal residents of the U.S. ages 21 or older. Employees and officers of DE, Allied Advertising Limited Partnership, and their respective parent and subsidiary companies and affiliates are not eligible to enter or win. Immediate family members and household members of such individuals are also not eligible to enter or win. “Immediate family members” shall mean parents, stepparents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household members” shall mean those people who share the same residence at least three months a year.

PRIZE/WINNER SELECTION/ODDS:  Winners will be selected in a random drawing. The odds of winning depend on the total number of entries received.  One (1) winner will receive a gratis bungalow valued at $3,000.00 to be reserved between March 16, 2022 – October 16, 2022.

CLAIMING PRIZE: Winners will be contacted by Sponsor as described below (“Win Notice”) and winners will be required to respond to Sponsor within 4 days after the first Win Notice to claim their prize.  Sponsor will require winners to present a valid U.S. government issued photo ID, and a signed Image Release within 7 days of the first Win Notice or the prize will be forfeited, and an alternate winner may be selected.  Winners age 21 or older may claim the prize at the dayclub as directed by Sponsor. All winners must follow these claiming prize procedures or forfeit the prize.  

Win Notice: a winner who entered on Instagram will be “tagged” and may receive a direct message.

All bungalow reservations are subject to the terms and conditions of the issuer, reservations may include an expiration date. A prize must be accepted as awarded and may not be sold and is not convertible to cash. Additional prize restrictions and terms may be imposed by prize providers.  If the prize is $600.00 or higher a 1099 tax form will be issued in the winner’s name for the ARV of the prize; in the event that a winner obtained other prizes from the Sponsor during the year with a total value of all prizes reaching $600, the winner will be required to execute certain tax documents and a 1099 will be issued in the winner’s name for the ARV of all prizes accepted by the winner in this calendar year. No prize substitutions or cash equivalents, except at the sole discretion of the Sponsor.  Prizes are non-transferable.

TERMS/INDEMNIFICATION: By participating in this Sweepstakes and/or by accepting any prize that you may be awarded, you agree that Sponsor, Instagram, and their respective parents, subsidiaries and affiliated companies, units and divisions; and Sponsor’s advertising and promotional agencies, and prize providers and each of their respective officers, directors, agents, representatives and employees; and their respective successors, representatives and assigns (collectively, the “Indemnified Parties”) shall not be liable for any and all actions, claims, including any injuries, losses or damages of any kind caused by your participation in this Sweepstakes or resulting from acceptance, possession or use of a prize.  By participating in the Sweepstakes and/or accepting any prize that you may be awarded, you agree to fully indemnify each Indemnified Party from any and all such claims by third parties. The Indemnified Parties shall not be liable for: (i) technical errors, data corruption, or unauthorized access to or alteration of entry or other materials; (ii) claims based on publicity rights, defamation, or invasion of privacy; or (iii) any printing, typographical, administrative, or technological errors in any materials associated with the Sweepstakes. Sponsor may prohibit participation in the Sweepstakes if, in its sole discretion, it determines a user is attempting to undermine the legitimate operation of the Sweepstakes by cheating or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Sponsor representatives. In the event of a dispute regarding the identity of a person submitting an entry, the entry will be deemed to be submitted by the person who registered the social media account. Sponsor will not distribute more than the stated number of prizes described.  A prize will remain unawarded if a winner fails to claim the prize. All properly claimed prizes will be awarded. Indemnified Parties are not responsible for any injury or damage to a participant’s computer related to or resulting from participating in promotion. Sponsor reserves the right to cancel the promotion if integrity of the promotion is compromised or corrupted.  Void where prohibited or restricted by law. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SWEEPSTAKES WEBSITE OR UNDERMINES THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHALL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. An entrant may be disqualified if they attempt to obtain more than the stated number of entries. Winner acknowledges that if the prize is attendance at an Event that is canceled or postponed for any reason: i) winner will need to follow Event producer’s instructions and procedures; and ii), Sponsor shall not be held accountable for any Event change or cancellation and Winner must attend the Event as scheduled. The winner is responsible for all local, county, state, and federal taxes on prizes based on the value of the prize.

RELEASE:  By entering, entrants agree to: (1) release the Sponsor and its agents, Instagram, from all liability, injuries, loss and/or damage of any kind arising from their participation in the Sweepstakes and the acceptance and use/misuse of any prize; (2) agree to be bound by the Official Rules and the decisions of the judge. Entrants authorize the Indemnified Parties to use their name, photo, hometown, Submission, and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law.  By accepting a prize, each winner consents to the use by Sponsor and its agent and affiliates of his/her name, hometown, and likeness for advertising and promotional purposes without additional compensation in all media (except if winner is a resident of TN or where otherwise prohibited by law).
